Whether you have advance notice of an upcoming compliance review or you'd simply rather be ready before one is ever scheduled, preparation comes down to the same core idea: know where your records are, and know what they'll show before someone else looks at them.

This is a general preparation guide, not a substitute for legal or compliance advice specific to your situation — especially if you're responding to an active review or enforcement matter.

Start With a Documentation Review

Before anything else, take stock of what you actually have versus what you're required to have. This means physically (or digitally) pulling together your records by category, not just assuming they exist because they did at some point.

Driver Files

Review every active driver's qualification file against the requirements in 49 CFR 391.51. Pay particular attention to medical certificate expiration dates and annual MVR reviews — these are the two elements most likely to have quietly lapsed since a driver's file was last touched. Our guide on keeping driver qualification files audit-ready covers this in more depth.

Vehicle Records

Confirm your maintenance files reflect an actual systematic program under 49 CFR Part 396 — inspection, repair, and maintenance history for every vehicle you control, not just proof of a passed annual inspection. Check that DVIRs show both reported defects and evidence those defects were actually corrected.

HOS/ELD Records

Pull a sample of recent driver logs and cross-check them against supporting documents (fuel receipts, dispatch records) for consistency. Look specifically for unresolved unidentified driving time and undocumented log edits — both are common, both are easy to miss, and both are exactly what a reviewer will check first. See our article on common HOS compliance mistakes for the recurring issues to watch for.

Drug and Alcohol Records

Confirm your random testing pool is current and that testing rates meet your program's requirements. Verify Clearinghouse pre-employment and annual queries are complete and documented for every current driver — see our Clearinghouse overview for what that involves.

Policies and Procedures

Written policies — drug and alcohol program policy, HOS policy, maintenance program documentation — should be current, signed where required, and actually reflect how your operation runs day to day. A written policy that doesn't match actual practice can raise more questions than having no written policy at all.

Insurance and Operating Authority Documentation

Confirm your proof of financial responsibility and operating authority filings are current and that your company's core identifying information on file with FMCSA is accurate.

Internal Compliance Checks

If you don't already have a recurring internal review process, a review preparation cycle is a good time to start one. Even a simple quarterly self-check across the categories above will surface most gaps before an external reviewer does.

Correcting Gaps Before an External Review

If your internal review turns up a gap — an expired certificate, a missing document — fix it now, using current, accurate documentation. Never backdate a record to make it appear a requirement was met earlier than it actually was. A current correction, properly documented, is a normal part of an active compliance program; a backdated one is a much more serious problem if discovered.

The goal of preparation isn't a perfect record. It's an honest, organized one that you can produce quickly.
